AQ Designs – Terms of Service
Welcome to AQ Designs. The terms “we”, “us” and “our” refer to AQ Designs. By using our website, services, or purchasing products, you agree to these Terms of Service (“Terms”) and our Privacy Policy. Please read carefully, and if you do not agree, do not use our services. To use our services, you must be at least 18 years old or have the consent of a parent or guardian. By creating an account, you represent that all information provided is accurate, complete, and current. You are responsible for maintaining the confidentiality of your account and password, and for all activities under your account. You may not transfer, sell, or assign your account to any other person without our written consent.
AQ Designs offers a variety of products and services including streetwear and casuals such as hoodies, T-shirts, crewnecks, golfers, caps, beanies, tracksuits, and bags; fully customized matric jackets with embroidery, badges, or prints; workwear and PPE including sets, overalls, scrubs, boots, and branded accessories; sports kits including custom kits for soccer, rugby, padel, tracksuits, training wear, and bags; corporate and end-of-year gifts such as custom-branded items and bundles; school uniforms including full school apparel and accessories; and AQ Designs merchandise including limited edition branded hoodies, caps, and T-shirts. While we strive for accuracy in descriptions, images, and pricing, please note that colors, sizes, materials, or appearances may vary due to device settings, lighting, or production differences.
Placing an order constitutes an offer to purchase, which we may accept or decline at our discretion. Orders are not confirmed until payment is received. For custom orders, including personalized designs such as embroidery, prints, or custom hoodies and T-shirts, customers must submit requests via WhatsApp or email after purchase, providing all necessary files, images, and instructions. AQ Designs is not responsible for errors in designs submitted by customers, and once production has started, custom orders cannot be canceled. Orders are assumed to be for personal use unless explicitly stated otherwise.
All prices are in South African Rand (ZAR) unless stated otherwise, and exclude taxes, shipping, and handling unless specified. Prices may change without notice, and the price at the time of order confirmation applies. Payment methods include Yoco, PayFast, and other approved gateways, and by providing a payment method, you confirm that you are authorized to use it. Delivery times are estimates only and may be affected by courier delays, customs, or other events beyond our control. Once goods are transferred to a courier, title and risk pass to the customer. AQ Designs is not liable for lost, damaged, or delayed packages once in transit. Standard products may be returned or exchanged according to our Refund Policy, while custom products such as personalized hoodies, matric jackets, or branded items are non-refundable unless defective or damaged. Customers must notify us within seven days of receiving a defective product and provide proof of the defect if requested.
All content on our website, including logos, images, text, designs, layouts, and branding, is owned by AQ Designs or its licensors. Use of this content for commercial purposes without written consent is prohibited. Customers retain ownership of designs submitted for custom orders, but AQ Designs reserves the right to display or use these designs for promotional purposes with consent. Our website may contain links to third-party websites or tools, and we do not control these third parties or their content. Use of any third-party tools is at your own risk.
We collect personal information in accordance with our Privacy Policy and POPIA (South Africa’s Protection of Personal Information Act). By using our services, you consent to the collection, storage, and use of your information for order fulfillment, customer service, and marketing purposes. By submitting suggestions, designs, or other feedback (“Feedback”), you grant AQ Designs a perpetual, worldwide, royalty-free license to use and display such Feedback for any purpose, and you warrant that it does not infringe the rights of third parties.
Our products and services are provided “as is” without warranties of any kind, and we do not guarantee that services or products will meet expectations, be uninterrupted, secure, or error-free. To the fullest extent permitted by law, AQ Designs is not liable for any direct, indirect, incidental, special, or consequential damages, including lost profits, revenue, or data. You may not use our services illegally or maliciously, infringe intellectual property or other rights, upload malware or viruses, spam, phish, harass others, or circumvent website security. We may suspend or terminate access to the Services for violations of these Terms, and you remain liable for all payments due up to the termination date.
These Terms are governed by South African law, and any disputes will be resolved in South African courts. AQ Designs may update these Terms at any time, and your continued use of our services constitutes acceptance of any changes.
